1. Validity
These terms and conditions govern Balloons & Lacey including www.balloonsandlacey.com performance relating to the sale and supply of goods to the customer. Balloons & Lacey reserve the right to amend these terms and conditions from time to time by updating this text page and the customer is bound by any such modifications or revisions.

2. Contract with customer
The contract between Balloons & Lacey and the customer comes into existence upon Balloons & Lacey's acceptance of the customers order i.e. when payment has been received. Balloons & Lacey is entitled to withdraw from contracts in the case of obvious typographical or arithmetical inaccuracies appearing on Balloons & Lacey website.

3. Privacy Policy
General
At Balloons & Lacey, we recognise that it is important to support the principle of protecting privacy on data transmitted over the internet in the context of current UK legislation. By using our website you consent to the collection of your information in accordance with this policy.

Registration and Privacy
When using the site, either at present or in the future, we may, at times, ask you to supply either/or an email address, username or password. We request this information to either uniquely identify yourself to supply online services or to return information to yourself via email or another data transfer system. We do not forward any of this information to mailing lists.

Stored Information
When you order, we need to know your name, e-mail address, delivery address, and credit or debit details. This allows us to process and fulfil your orders and to notify you of the status of your order. We may also ask for your telephone number, which enables us to contact you urgently if there is a problem with your order. This information remains within the business and is not forwarded or sold to any third party

The site, may, either at present or in the future, contain a number of links to other sites. You should be aware that these sites are beyond our control and are therefore not covered by this statement.

We reserve the right to modify or update this privacy statement without prior notice.

4. Pricing and Availability
The prices of the goods are those specified on Balloons & Lacey Web site. The price, as displayed, is inclusive of VAT (at the standard UK rate). There will be an additional charge for delivery. Orders are subject to availability. In the unlikely event that the goods are unavailable, the customer will be notified by Email. Price and availability information is subject to change without notice.

Telephone Orders and Collection orders MUST be a minimum of £15. We encourage our customers to place orders on the site as it is a fast, efficient and secure. Collection orders MUST be booked in a minimum of 48 hours in advance and are subject to the discretion of management.

5. Delivery of balloons
1st Class (Free)
Your balloon will be sent by Royal Mail 1st Class post and will be dispatched the day before delivery is requested. Please note that 1st Class deliveries are not guaranteed to arrive on a specific day. If your balloon requires a guaranteed delivery date you should choose a Special Delivery option.

While Royal Mail deliver 80 to 90% of 1st Class post next day, there is no guarantee your balloon will arrive on the day chosen. Sorry but refunds for late delivery on balloons sent by 1st Class mail cannot be given. Please note 1st Class deliveries do not require a signature and therefore we have no way to track your order.

Special Delivery (9am / 1pm)
Your balloon will be sent by Royal Mail Special Delivery.
This guarantees your balloon will have a delivery before your chosen time on your chosen day (Monday to Saturday).
A signature will be required from anyone at the delivery address.

If for some reason a delivery attempt has not been made by your chosen time on the chosen day you will be entitled to a £9 refund for the 9am option or a £5 refund for 1pm option.

Special Delivery Details
If no-one is available at the delivery address to sign for the balloon a card will be left informing the recipient that a Special Delivery attempt has been made. This card gives a phone number and clear instructions on how to get the balloon re-delivered or where the balloon can be picked up from (Local Royal Mail sorting office)

6. Delivery of Goods
Balloons & Lacey will deliver the goods ordered to the delivery address supplied by the customer. Availability permitting, all orders paid for by credit card will be delivered within 3 to 5 working days. Balloons & Lacey is entitled to deliver in part. Despatch of goods constitutes fulfillment of contract.

7. Balloons & Lacey Warranty
If the goods delivered are not what the customer ordered, or are of incorrect quantity, or are damaged or defective, Balloons & Lacey will, if the customer returns them within a fifteen-day period, at the customer's option either give a full refund or where possible make good any shortage or non-delivery or replace any damaged or defective goods.

8. Return of goods - 100% money back guarantee.
All goods purchased from Balloons & Lacey may be returned for refund, exchange or replacement within 7 working days from receipt of delivery [*].

Before sending the parcel back to us, please contact us via e-mail at help@balloonsandlacey.com for a Returns Authorisation Number. You will be asked for the reason for the return including whether you will prefer a refund or exchange plus whether the item has been used. In addition, you will need to confirm your name, order number and postcode, so please have these available. You will need to include this Returns Number with your parcel back to us as failure to do so may result in delay of any refund. May we please ask you to additionally note:

1. You must take care of our goods whilst they are in your possession and any item for return must be received back in its original shipped condition and original packing. The item must be without damage or use and in a suitable condition for resale. Please note that we CANNOT accept returns of disposable helium gas cylinders. All original packaging should accompany any returned item. We cannot accept returns for exchange or refund if such items have been opened from a sealed package. All items will be inspected on their return to our warehouse.
We are not a manufacturer, so the whole product and packaging must be returned as the same condition as you would have received it and how you may expect to receive it. If the product or packaging is in any way missing or damaged, we cannot refund.

2. You or your carrier is responsible for any returned goods until they reach our warehouse. Cost and Risk of return will be at your expense and we strongly recommend that you receive proof of posting or use Royal Mail's "Recorded Signed" service. You may like to opt for Royal Mail's "Special Delivery" service if a valuable item.

3. We regret that outbound shipping, packing and insurance cannot be refunded. For exchanged items, you may be asked for a nominal fee as a contribution towards any additional postage of shipping, depending on which shipping method you require.

4. We try to make refunds within one week of receipt back to us though promise to make all refunds within 30 calendar days from receipt of goods to our warehouse. Please note that we will not be held liable for any interest payment that you may incur because any refund was made outside of your credit/debit card timescale's.

5. Please return the goods to the address on the top of your receipt/invoice including the Returns Authorisation Number. Any returned items not including such information may well be delayed.

6. Any returned goods that we receive which are outside of this Returns Policy will be defined as 'In Dispute'. Such In Dispute items will not be refunded or exchanged. A reason for this decision will be provided. We are happy to re-ship such In Dispute items back to you; otherwise they will be destroyed within 91 calendar days from their receipt back to us.

7. We are sorry but due to false promises in the past, we are unable to replace or exchange an item until the original is returned to Balloons & Lacey. If you need an item in a hurry, we suggest you place a second order for the new item and send the original back at a later date.

8. Sometimes and especially if goods are purchased in advance for a present or delivered while on holiday, aforementioned 7 day response timescale's can be missed. Therefore, without prejudice and as a gesture of goodwill, we are happy to consider the following remedy on a case by case basis:

Should an item not be required and is returned and received by us between 7 working days and 30 calendar days, we will be happy to accept the item(s) back with refund of goods to the value of 60% of the purchase price (excluding shipping) or refund of 100% if taken as a gift certificate or coupon redeemable in the future at Balloons & Lacey.
Should an item be returned and received after 30 calendar days, we will have no obligation to refund. If you wish the item resent to you, we will ask for a nominal fee to cover additional shipping costs.

[*] "7 working days from receipt of delivery" shall be defined as the date from when your shipment is received by you, being the date of signature that the package is received by you.

9. Governing Law and Jurisdiction
Contracts between Balloons & Lacey and the customer will be governed by English Law and all disputes will be submitted to the non-exclusive jurisdiction of the English courts.

10. Intellectual Property
All the information, data, text, graphics, links or computer code published on, contained or available on this website (the "Material") are the copyright of Balloons & Lacey. Unauthorised use of the Material including the production, storage, modification, distribution or republication without the prior written consent of Balloons & Lacey or, where applicable, the respective copyright owner(s) is prohibited. The names and logos of Balloons & Lacey and all related products and service names, design marks and slogans are the trade names, service marks or trade marks of Balloons & Lacey and may not be used without the prior consent of Balloons & Lacey.

11. Disclaimer
Balloons & Lacey hereby, to the fullest extent permitted by law, disclaims all warranties and conditions with regard to the Material and any goods and services supplied in relation to this website, whether expressed or implied or statutory (including all implied warranties and conditions of the merchant ability and fitness for a particular purpose). In no event that Balloons & Lacey be liable for any indirect, punitive, special, incidental or consequential damages whatsoever even if Balloons & Lacey has been advised of the possibility of damages including, without limitation, damages for loss of use, data or profits arising out of or in any way connected with the use or performance of this website, interruptions or delays to this website, the provision of or failing to provide services, or for any information, material, goods and services obtain through this website or otherwise arising out of the use of this website, whether based on contract, tort or otherwise to the fullest extent permitted by law.

12. Newsletter
Balloons and Lacey will not sell or rent your details. We reserve the right to increase or decrease the frequency of the bulletin release at any time. We reserve the right to send HTML format bulletins. A customer reserves the right to opt out of direct marketing campaigns at any time - please contact info@balloonsandlacey.com.

In accordance with the data protection act, any existing customer of Balloons & Lacey will be included in any direct marketing strategies unless that customer has chosen to opt out.

13. Security
Balloons & Lacey payment pages are held on PayPal servers to ensure as secure and reliable a service as possible. Balloons & Lacey does not hold or collect credit card details. If any payment details of this type are used to fulfil a manual order they are used once to facilitate payment and then destroyed.

PayPal ensures safe and secure payment by using an SSL (Secure Socket Layer) enabled link.

Only if your credit card has been authorised will your credit card be debited.

14. Invalidity of Terms and Conditions
If for any reason part of these terms and conditions is unenforceable; the validity of the remaining terms and conditions will not be affected.
